IMPORTANT: Please read these Terms and Conditions carefully before using Bekirim. By accessing or using the Bekirim application, website, or services, you agree to be bound by these terms. If you do not agree, you may not use our services.
Governing Law: These terms are governed by the laws of Brunei Darussalam.

SECTION 1: GENERAL TERMS
1.1 DEFINITIONS
- "Bekirim" or "We/Us" refers to Bekirim and its operators
- "App" refers to the Bekirim mobile and web application
- "Service" refers to the delivery services provided through Bekirim
- "User" refers to any person using the App
- "Customer" refers to a User who requests a delivery
- "Driver" refers to an independent contractor who accepts and fulfills deliveries
- "Admin" refers to Bekirim's administrative staff
- "Digital Wallet" refers to the in-app payment account (for customers and drivers)
1.2 ACCEPTANCE OF TERMS
By using Bekirim, you:
- Confirm you have read, understood, and agree to these Terms and Conditions
- Confirm you are of legal age (minimum 12 years old with parental consent for customers; 18 years or older for drivers)
- Confirm you are legally capable of entering into binding contracts under Brunei law
- Agree to comply with all applicable laws in Brunei Darussalam and Borneo
1.3 MODIFICATION OF TERMS
Bekirim reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Continued use of the App after modifications constitutes acceptance of the updated terms. We recommend reviewing these terms regularly.
1.4 SERVICE DESCRIPTION
Bekirim operates a delivery platform that:
- Connects Customers with Drivers who have pre-planned routes
- Allows Customers to request deliveries along Driver routes
- Facilitates payments through manual bank transfer verification and Digital Wallet
- Operates primarily in Brunei Darussalam with ability to serve areas within Borneo as permitted by law
- Does not guarantee specific delivery times but aims for efficiency

SECTION 2: USER ACCOUNTS AND REGISTRATION
2.1 ACCOUNT ELIGIBILITY
- Customers: Minimum 12 years old. If under 18, parental or guardian consent is required.
- Drivers: Must be 18 years old or older, or as otherwise legally stated in Brunei.
2.2 REGISTRATION REQUIREMENTS
To register on Bekirim, you must provide:
- Full legal name
- Valid contact information (phone number, email)
- Valid identification
- For Drivers: Valid driver's license and proof of vehicle insurance
2.3 ACCOUNT ACCURACY
You are responsible for:
- Providing accurate, complete, and truthful information during registration
- Maintaining the confidentiality of your account credentials
- Notifying Bekirim immediately of any unauthorized access
- All activities that occur under your account
2.4 DRIVER APPROVAL PROCESS
- Driver applications are reviewed by Bekirim Admin
- Approval is at Bekirim's sole discretion
- Drivers must meet all eligibility requirements and pass verification checks
- Bekirim may reject applications without providing specific reasons
- Once approved, drivers agree to maintain compliance with all policies
2.5 ACCOUNT TERMINATION
Bekirim reserves the right to suspend or terminate any account:
- If the user violates these terms
- If the user engages in fraudulent activity
- If the user is involved in illegal conduct
- For any reason at Bekirim's discretion, with notice where applicable

SECTION 3: CUSTOMER TERMS
3.1 ORDERING DELIVERIES
- Customers use the App to request deliveries along available Driver routes
- Delivery requests must include accurate pickup and delivery locations
- Customers confirm they have the right to request delivery of the items
- Bekirim does not guarantee specific delivery times
3.2 PROHIBITED ITEMS
Customers may not request delivery of:
- Illegal goods or contraband
- Weapons or explosives
- Hazardous materials
- Stolen property
- Items that violate Brunei law
- Perishable goods without proper packaging (at Bekirim's discretion)
3.3 PAYMENT
- Customers may pay via manual bank transfer (verified by Admin) or Digital Wallet
- Manual bank transfer payment requires Admin verification before service completion
- Digital Wallet payments are processed through the wallet account
- Customers are responsible for ensuring sufficient funds
- Bekirim is not liable for payment processing delays or bank errors
3.4 DELIVERY FEES
- Delivery fees are calculated and displayed before order confirmation
- Fees may vary based on distance, route, and other factors
- Customers must accept fees before confirming an order
- No refund of delivery fees if Customer cancels after Driver acceptance
3.5 CANCELLATION AND REFUNDS
- Customers may cancel orders before a Driver accepts the delivery request
- Once a Driver accepts, cancellation is subject to mutual agreement between Customer and Driver
- If both parties agree to cancel after Driver acceptance, a refund may be issued
- Admin may intervene in disputes regarding refunds
- Refunds are processed within 5 to 7 business days
- Payment method for refunds will be the same as the original payment method
- Refunds are not guaranteed and depend on circumstances and mutual consent
3.6 DELIVERY RESPONSIBILITY
- Customers are responsible for ensuring someone is available to receive the delivery
- Drivers are not responsible if Customer is unavailable at delivery location
- Customers assume responsibility for items upon delivery
- Bekirim is not liable for loss or damage to items after delivery is completed
3.7 COMMUNICATION
- Customers may communicate with Drivers through the App
- Customers must maintain respectful communication
- Any disputes should be reported to Admin for resolution

SECTION 4: DRIVER TERMS
4.1 DRIVER STATUS
- Drivers are independent contractors, not employees
- Drivers are solely responsible for their vehicle and all associated costs
- Drivers are not authorized to represent Bekirim as employees
4.2 ELIGIBILITY REQUIREMENTS
Drivers must:
- Be 18 years old or older (or as otherwise legally stated)
- Possess a valid driver's license under Brunei law
- Own or have permission to operate a personal vehicle
- Maintain valid car insurance that covers delivery services
- Pass Bekirim's verification process
- Comply with all traffic laws and safety regulations
4.3 VEHICLE REQUIREMENTS
- Drivers must use a personal vehicle in safe, roadworthy condition
- Drivers must maintain valid, current car insurance
- Vehicle must be registered and legal for use in Brunei
- Drivers are responsible for all vehicle maintenance, fuel, and insurance costs
- Bekirim is not liable for vehicle damage or maintenance
4.4 ROUTE ACCEPTANCE
- Drivers with pre-planned routes list their routes on the App
- Customers can request deliveries along these routes
- Drivers accept delivery requests at their discretion
- Once a Driver accepts a delivery, they commit to completing it
- Drivers may not cancel accepted deliveries without valid reason
4.5 DELIVERY OBLIGATIONS
Drivers must:
- Complete accepted deliveries in a timely manner
- Handle items with reasonable care
- Communicate professionally with Customers
- Follow all traffic laws and safety regulations
- Not open, inspect, or consume Customer items (unless necessary for safety)
- Obtain proof of delivery (photos, signatures, etc. as required)
4.6 PAYMENT AND DIGITAL WALLET
- Drivers are paid through the Digital Wallet for each completed delivery
- Payment amounts are determined by Bekirim and displayed before Driver acceptance
- Payments are processed upon delivery completion and verification by Admin
- Drivers may withdraw Digital Wallet funds via manual bank transfer
- Withdrawals are manually verified by Admin before processing
- Withdrawal processing may take 5 to 7 business days
- Bekirim is not liable for delays in payment processing or bank errors
4.7 DEACTIVATION AND SUSPENSION
Bekirim reserves the right to suspend or deactivate a Driver account:
- If the Driver violates these terms
- If the Driver receives multiple complaints
- If the Driver engages in unsafe or unprofessional conduct
- If the Driver's insurance lapses or becomes invalid
- For any reason at Bekirim's discretion
4.8 INSURANCE RESPONSIBILITY
- Drivers are solely responsible for maintaining valid car insurance
- Drivers must ensure their insurance covers delivery services
- Bekirim does not provide insurance coverage
- Drivers are liable for any accidents, injuries, or damages involving their vehicle
- Customers should report accidents immediately to Admin
4.9 SAFETY AND CONDUCT
Drivers must:
- Maintain safe driving practices
- Not operate under the influence of drugs or alcohol
- Not engage in harassment, discrimination, or abuse
- Not share Customer personal information
- Report safety concerns to Admin immediately

SECTION 5: PAYMENTS AND DIGITAL WALLET
5.1 PAYMENT METHODS
Bekirim accepts:
- Manual bank transfer (verified by Admin)
- Digital Wallet funds (loaded via bank transfer and verified by Admin)
5.2 DIGITAL WALLET
- The Digital Wallet is an in-app payment account
- Customers and Drivers can load funds via manual bank transfer
- All transfers are manually verified by Admin before crediting the wallet
- Digital Wallet balances are non-refundable except for failed or disputed transactions
- Bekirim is not liable for unauthorized wallet access
5.3 PAYMENT VERIFICATION
- All bank transfers are manually verified by Bekirim Admin
- Verification may take 1 to 3 business days
- Customers and Drivers will be notified once payment is verified
- Services will not begin until payment is verified
5.4 FEES AND CHARGES
- Delivery fees are displayed before order confirmation
- Additional fees may apply for special requests or circumstances
- Bekirim reserves the right to adjust fees with notice
- No refunds are provided for applicable service fees
5.5 DISPUTED PAYMENTS
- Customers or Drivers may dispute a payment or charge
- Disputes must be reported to Admin within 30 days
- Admin will investigate and determine resolution
- Resolution is at Admin's discretion based on evidence

SECTION 6: LIABILITY AND DISCLAIMERS
6.1 LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY BRUNEI LAW:
- Bekirim provides the Service "as-is" without warranties of any kind
- Bekirim is not liable for any indirect, incidental, special, or consequential damages
- Bekirim is not liable for loss of data, revenue, or profits
- Bekirim is not liable for service interruptions or delays
- Bekirim is not liable for third-party actions or conduct
6.2 NO LIABILITY INSURANCE
- Bekirim does not maintain liability insurance at this time
- Users acknowledge this and proceed at their own risk
- Drivers are responsible for their own insurance and liability
6.3 USER RESPONSIBILITY
- Users assume all risks associated with using the Service
- Bekirim is not liable for:
- Delivery delays or failures
- Item loss, damage, or theft after delivery
- Driver conduct or accidents
- Payment processing delays
- Service interruptions
- Third-party actions
6.4 FORCE MAJEURE
Bekirim is not liable for failure to perform services due to:
- Natural disasters
- Acts of God
- War, terrorism, or civil unrest
- Government action
- Strikes or labor disputes
- Pandemics or public health emergencies
- Any event beyond Bekirim's reasonable control
6.5 NO WARRANTIES
Bekirim makes no warranties regarding:
- Availability or continuity of the Service
- Accuracy of delivery times
- Quality of Driver services
- Fitness of the Service for any particular purpose
- Non-infringement of third-party rights

SECTION 7: DISPUTE RESOLUTION
7.1 DISPUTE RESOLUTION PROCESS
In the event of a dispute:
1. The parties must attempt to resolve the issue through negotiation
2. If negotiation fails, the parties agree to mediation through Bekirim Admin
3. If mediation fails, the dispute will proceed to arbitration under Brunei law
7.2 ARBITRATION
- Disputes will be resolved by arbitration under Brunei law
- The arbitrator will be selected by mutual agreement or appointed by Bekirim
- Arbitration will be conducted in Brunei
- Decisions are binding and enforceable
- Each party bears its own costs unless the arbitrator orders otherwise
7.3 CLAIM LIMITATIONS
- Claims must be based on what a reasonable person would consider appropriate
- Claims must be supported by evidence
- Claims must be filed within 30 days of the incident
- Claims older than 30 days may not be considered
7.4 SMALL CLAIMS
- Customers may pursue claims in Brunei's small claims court if applicable
- Small claims proceedings are not subject to arbitration
7.5 NO CLASS ACTIONS
- Users agree not to pursue class action lawsuits
- All disputes must be resolved individually

SECTION 8: INTELLECTUAL PROPERTY
8.1 BEKIRIM OWNERSHIP
- All content, design, and functionality of the App are owned by Bekirim
- This includes logos, trademarks, text, graphics, and code
- Users may not reproduce, modify, or distribute any Bekirim content
8.2 USER CONTENT
- Users retain ownership of any content they create (photos, messages, etc.)
- By submitting content, Users grant Bekirim a license to use the content for operational and marketing purposes
- Users agree not to infringe on third-party intellectual property rights

SECTION 9: MISCELLANEOUS
9.1 ENTIRE AGREEMENT
These Terms and Conditions, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between the parties.
9.2 SEVERABILITY
If any provision is found invalid, the remaining provisions remain in effect.
9.3 GOVERNING LAW
These terms are governed by the laws of Brunei Darussalam, without regard to conflicts of law.
